FluxketchTerms of Use
This is an English translation for convenience. If it differs from the Korean version, the Korean version prevails.
1. Purpose and scope
These terms set out the conditions for using Fluxketch (the "App"), an iPad and iPhone application provided by Fluxketch (the "Company"). By downloading and using the App you agree to these terms.
2. Your content
All rights to the drawings, markups, pins, notes and reports you create or import in the App belong to you. The Company does not view or collect that content (see the Privacy Policy). Files sent to the server for DWG conversion are deleted as soon as conversion finishes.
3. Plans and payment
- Free: every feature of the App is free for your first 5 DWG/DXF imports within 30 days of the first import. Once all 5 are used, you can view drawings and use the schedule until those 30 days end; after 30 days, your next import starts a new allowance of 5. PDF and iCloud project imports and the sample drawing do not count. (In App version 1.1.1 and earlier, up to 3 DWG/DXF imports are free.)
- iPad plans: Lite provides drafting, editing, blocks, layouts, plot (PDF output) and DXF export; Markup provides markup, field pins, notes, reports and plot (PDF output), without drafting or editing; Pro provides everything in Lite and Markup. Paid plans include unlimited DWG/DXF imports. Monthly and yearly billing are available.
- iPhone plan: provides the paid features on iPhone (creating pins, markup, markup PDF sharing, DXF export, plot, notes, reports, iCloud upload and more). Monthly and yearly billing are available. With an active Pro subscription on the same Apple Account, every feature on iPhone is included without the iPhone plan. Lite and Markup subscriptions do not unlock paid features on iPhone.
- No free trial (a trial period followed by automatic billing) is currently offered.
- Subscription products and prices are shown on the in-app purchase screen. The actual amount and currency are set by Apple according to your App Store region.
- Payment is charged to your App Store account when you confirm the purchase.
- Subscriptions renew automatically. Unless cancelled at least 24 hours before the current period ends, the next period is charged at the same price.
- You can cancel anytime in Settings › Apple Account › Subscriptions on your iPad or iPhone, or from the Subscription screen (Plan on iPhone) in the App's settings. Cancelling stops the next charge only; you keep access until the end of the period already paid for.
4. Cancellation and refunds
- Apple is the seller of in-app purchases, and Apple handles payments and refunds. The Company cannot issue refunds directly.
- You can request a refund at reportaproblem.apple.com. Apple decides according to its own policies.
- Under Korea's Act on the Consumer Protection in Electronic Commerce, you may withdraw a purchase within 7 days of payment. However, under Article 17(2)(5) of that Act, withdrawal may be limited for digital content whose value has been substantially reduced by use (for example, if you actually used paid features during the subscription period). Even then, withdrawal is possible for the unused portion.
- When a refund is approved, the subscription entitlement is removed from the App automatically.
- If you could not use the service because of the Company's fault, email flux0720@fluxketch.com and we will guide you through Apple's refund process.
5. What you must not do
- Reverse-engineer, copy or redistribute the App
- Create or share content that infringes the law or the rights of others (including copyright)
- Interfere with the normal operation of the service
6. Limitation of liability
To the extent permitted by law, the App is provided "as is". The Company is not liable for indirect or incidental damages arising from use of the App. This does not limit liability for damages caused by the Company's intent or gross negligence, or rights guaranteed to consumers by law. Please keep separate copies of important drawings.
7. Changes to these terms
The Company may change these terms and will announce changes on this page and in the App 7 days before they take effect (30 days for changes unfavorable to users).
8. Governing law and jurisdiction
These terms are governed by the laws of the Republic of Korea, and disputes are handled by the court with jurisdiction under the Civil Procedure Act.
